Abstract
Les sociétés modernes ont été des sociétés révolutionnaires ; tournées vers la rationalisation de domaines autonomes de la pratique sociale, elles élevaient le problème de l'unité de l'action sociale au niveau d'un droit formel, universaliste et abstrait, compris lui-même comme déduction d'un idéal de justice caractérisée par la liberté individuelle. L'indétermination de cette idée de justice, c'est-à-dire l'impossibilité de déduire un contenu concret d'un principe, a entraîné une crise du pouvoir défaire le droit et la mise en place de procédures inductives et pragmatiques de reconnaissance des droits invoqués au gré des conflits sociaux par les différentes catégories d'acteurs.
