De privé qu’il était à l’origine, le système d’arbitrage des griefs est devenu de plus en plus public tout en conservant pour l’essentiel l’ensemble des caractéristiques d’un régime privé quant à son mode de fonctionnement. Cette évolution se manifeste par un élargissement du champ d’intervention de l’arbitre de griefs dans des domaines qui étaient l’apanage des tribunaux de droit commun. Cela pose question sur le triple plan de l’indépendance, de la compétence et de l’accessibilité des arbitres au regard de la rémunération et de l’appréciation de leur compétence par les parties. Rejetant la création d’une commission nationale de l’arbitrage, l’auteur estime qu’il y a lieu de rechercher d’autres voies et moyens qui permettraient de conserver le plus possible des éléments du régime actuel, et ce, en assurant au mieux l’indépendance et la compétence professionnelle des arbitres, notamment par la mise en place d’un mode de certification des arbitres et de répartition des dossiers.
