Dans le présent article, l’auteur analyse la norme de tolérance de la société canadienne contemporaine, balise interprétative permettant d’apprécier le caractère criminellement répréhensible de conduites pouvant potentiellement corrompre les mœurs, à l’aide des décisions clés circonscrivant son application. Dans cette foulée, l’auteur s’attache particulièrement à étudier l’arrêt Labaye, et incidemment l’arrêt Kouri, deux décisions découlant de trames factuelles distinctes, quoique similaires, où la Cour d’appel du Québec a dû déterminer, par le truchement de la norme de tolérance, si les actes d’échangisme reprochés étaient criminellement indécents. L’analyse s’opère en deux étapes : la première, consacrée à l’évolution de la norme de tolérance et à son contexte d’application particulier en matière d’indécence, esquisse les grands traits de cette notion aux contours fort singuliers. La seconde, illustrant la complexité inhérente à sa mise en application, met en relief, dans une perspective essentiellement critique, l’application de cette norme ayant été effectuée à l’occasion de l’arrêt Labaye. L’auteur conclut que les motifs des opinions majoritaires distinctes rendues par les juges Rochon et Rayle dans ce dernier arrêt s’inspirent de considérations essentiellement subjectives et arbitraires. En ce sens, il précise qu’une application objectivement rigoureuse de la norme aurait dû permettre à l’appelant Labaye d’être acquitté.
