More than a quarter of senior commissioning leaders in England say that their organisation has opened up NHS services to competition owing to fears of legal action, a new survey has found. A fifth of respondents to the poll by the Health Service Journal 1 said that their clinical commissioning group (CCG) had been formally challenged under new competition rules established by the Health and Social Care Act 2012, which came into force in April 2013.
