L’analyse comparée de processus poursuivant des fins identiques dans un cadre institutionnel répondant aux mêmes valeurs permet de dégager les éléments susceptibles de constituer un « idéal type » qui aménage les pratiques recensées les plus exemplaires pour atteindre la finalité recherchée. Cet article s’inscrit dans cette vision en faisant ressortir les voies et moyens les plus susceptibles d’assurer en régime parlementaire –mode institutionnel le plus répandu dans le monde contemporain –les processus de sélection et de nomination des magistrats qui fournissent les garanties indispensables d’indépendance, d’impartialité et de transparence. Ces démarches sont complexes et délicates dans la mesure où elles doivent permettre de déterminer les compétences maîtrisées des candidats qui postulent une charge de juge et de procéder à la nomination des plus méritants dans le respect des prérogatives associées à l’exercice de la fonction gouvernementale.
