En 1839, Lord Durham recommanda l'union législative des deux Canadas comme solution aux problèmes économiques et politiques de ces provinces. La même année, Lord John Russell, Secrétaire aux colonies, faisait part de ce projet à ses collègues de la Chambre des Communes. Le Bill de l'Union fut présenté le 23 mars et voté le 23 juillet 1840. La Loi d'Union des deux Canadas (3 et 4 Victoria, ch. 35) entra en vigueur après une proclamation officielle du 5 février 1841. La proclamation fut transmise à l'Assemblée canadienne par Lord Sydenham, le 10 février de la même année. C'est ainsi qu'entre la publication du Rapport de Lord Durham, à l'automne de 1839, et la proclamation de la Loi d'Union, en 1841, s'est déroulé le stratagème politique qui aboutit à l'union effective de deux Canadas, prélude à la Confédération de 1867. Lord Durham et Lord Sydenham ont été les personnages-clés de ce drame impérial qui eut pour théâtre l'Amérique du Nord. L'un et l'autre y ont joué des rôles différents mais complémentaires : Durham en tant qu'enquêteur et architecte, Sydenham en qualité d'exécutant. Le plan Durham fut conçu dans la perspective de la juridiction impériale, en fonction de l'intégrité du territoire canadien, sans égard pour la population francophone. Celle-ci devait, dans le cadre politique d'un Canada unique, être assimilée par la population anglophone et impérialisante. Le plan d'action de Sydenham ne réservait aucune place à la consultation des Canadiens français ; il méprisait même l'opinion des factions réformistes du Haut-Canada ; il s'affirmait comme impérial et supracolonial. Cette étude veut rappeler les recommandations économiques du Rapport de Lord Durham, mesurer les dimensions du plan de Sydenham, évaluer la condition nord-américaine des provinces britanniques et leur évolution en tant que limites ou obstacles à ce plan et à la volonté de son exécutant.
