Abstract
À la lumière des récents développements judiciaires, l’objectif de l’auteure est d’examiner la nature et l’origine des difficultés éprouvées par certains travailleurs non salariés vulnérables dans l’accès à la syndicalisation. À partir de l’analyse de trois situations de travail dites vulnérables, l’auteure démontre que la loi ordinaire joue un rôle moteur dans l’exclusion de l’accès à la syndicalisation des travailleurs vulnérables. L’interprétation restrictive livrée par la Cour suprême du Canada à l’égard de l’article 2 d) de la Charte canadienne des droits et libertés ne permet pas de juguler efficacement cette trajectoire du législateur. Il faut donc envisager une protection renforcée de la liberté d’association garantie constitutionnellement au moyen d’une interprétation plus large et inspirée du droit international. Parallèlement, il s’agit de considérer l’ensemble des moyens non traditionnels offerts sur la scène nationale et internationale pour offrir l’accès à la liberté d’association et assurer une protection efficace à ces travailleurs vulnérables.
