Le présent article tentera d’illustrer que l’utilisation des différentes méthodes d’interprétation législative qu’un interprète défend peut permettre de mettre en lumière les théories constitutionnelles plus générales auxquelles il adhère. Cette analyse permettra plus précisément d’identifier les théories constitutionnelles de Louis-Philippe Pigeon, juge à la Cour suprême du Canada de 1967 à 1980. Juriste auprès de différents gouvernements provinciaux, professeur de droit constitutionnel à la Faculté de droit de l’Université Laval, puis juge à la Cour suprême, Louis-Philippe Pigeon approfondit pendant de nombreuses années ses théories constitutionnelles. Toutes sont marquées par la mise en oeuvre des méthodes d’interprétation législative qui lui sont chères. Notre analyse se développe autour de deux thèmes distincts. C’est avant tout par la recherche de l’efficience du partage des compétences législatives que se traduit la conjugaison faite par Louis-Philippe Pigeon entre l’interprétation législative et le droit constitutionnel. Ses opinions dans ce domaine sont d’ailleurs toujours suivies aujourd’hui. À l’opposé, son interprétation des droits fondamentaux protégés par la Déclaration canadienne des droits, basée sur les principes d’interprétation littérale qu’il défend, s’allie difficilement avec la portée que leur accorde la jurisprudence contemporaine. Ralliées à la dissidence, les théories constitutionnelles que défend alors le juge Pigeon sont propres au principe de la séparation des pouvoirs.
