Cette étude porte sur les problématiques éthiques de la violation de la confidentialité du dossier médical des enfants, dans un contexte où les diagnostics psychiatriques sont utilisés pour déterminer le cadre pédagogique et le financement d’établissements scolaires, alors que le contenu du dossier médical devrait rester confidentiel. Nous avons exploré les perceptions et le sens de la responsabilité sociale en regard de la confidentialité du contenu des dossiers médicaux des enfants chez des professionnels de l’éducation et de la santé, ainsi qu’auprès de parents et de régulateurs. Les résultats permettent d’observer que les professionnels de la santé ont une vision qui s’apparente à la déontologie, alors que les professionnels de l’éducation et les administrateurs s’inspirent d’une approche plus culturelle (mœurs) qu’éthique. Dans ce cas, la logique administrative semble prévaloir sur le respect de la confidentialité qui est violée pour des motifs tantôt légitimes, tantôt discutables, mais qui réduit le droit fondamental d’un individu à bénéficier de la confidentialité des informations concernant sa santé.
