Abstract
En 1994, l’Institut international pour l’unification du droit privé (Unidroit) a publié les Principes relatifs aux contrats du commerce international. Ce texte simplement proposé à la communauté internationale par Unidroit n’a fait l’objet d’aucune ratification par des États ou des organismes internationaux. Le caractère privé des Principes les distingue de la plupart des instruments élaborés en vue de l’unification du droit. Il convient donc de se demander si les Principes peuvent être considérés comme une codification. Or, dans la mesure où ils se présentent comme un ensemble de règles relatives au contrat du commerce international organisé d’une manière systématique et cohérente et qu’ils reprennent des règles existantes du droit du commerce international ou de la lex mercatoria, les Principes peuvent être considérés comme une codification.
