Cet article présente la structure juridique du quotidien montréalais Le Devoir. Constituée sous la forme d’une société par actions en vertu du droit fédéral, la société va faire l’objet d’un aménagement singulier. La compréhension qu’ont eue de cet aménagement les directeurs et les administrateurs au cours des décennies qui vont suivre sa fondation en 1910 est particulièrement intéressante. En effet, à des moments clés de l’histoire du journal, les acteurs principaux semblent saisir avec plus ou moins de clarté l’étendue de leurs pouvoirs. Même si l’aménagement a pu s’avérer bancal, sinon illégal, il demeure que les successeurs du fondateur Henri Bourassa ont toujours conservé l’objectif initial d’assurer à la direction la liberté nécessaire pour la mettre à l’abri des pressions externes.
