Abstract
Soûlards indiens et flics blancs. Considérations théoriques sur la récidive Cet article propose un cadre théorique pour clarifier la sur-représentation ethnique dans le système de justice pénale en démocratie libérale. Grâce à l'examen d'un cas extrême d'ivresse en public au Canada, nous montrons que la récidive chez les Indiens n'est que le stade avancé d'un processus historique de conflit inter-ethnique entre ceux-ci et la majorité blanche tant sur les ressources que le pouvoir. La récidive est l'une des scènes où est contestée une relation de domination, passée et présente. Bien qu'en apparence une telle situation semble marquée par la rigueur de la justice pénale et du centralisme juridique, elle évolue en pratique dans un contexte de pluralisme juridique.
