Abstract
La présente étude situe la réalité et l’importance de l’activité régulatrice des acteurs du cyberespace. Le texte, qui choisit l’angle de l’analyse juridique, définit le cyberespace et évalue son impact sur l’effectivité des normes formelles étatiques. Il tente ensuite de démontrer comment le produit de l’activité autorégulatrice du cyberespace, incarné par les normes informelles, pourrait constituer le complément normatif des normes formelles. La démonstration inclut la définition et l’identification des caractères et des sources des normes informelles, de même que l’appréciation de leurs effets et du regard que les législateurs et les juges y portent. Elle ouvre, enfin, sur les perspectives de cette approche de co-régulation.
