Abstract
Tout le monde parle aujourd'hui de la mondialisation. Cependant, est-on seulement conscient qu'au cœur des diverses transactions internationales qui la cristallisent se trouve un principe cher aux États libéraux de l'heure ? Ce principe n'est autre que celui de l'autonomie de la volonté. Prosaïquement, ce concept exprime la faculté laissée à toute personne qui en est capable de nouer une relation juridique avec une autre indépendamment de certaines contraintes. Bien sûr, cette forme de liberté doit être exercée dans le respect des autres acteurs de la scène internationale, comme le sont les entités étatiques. Le récent échec de l'Accord multilatéral sur les investissements (AMI,) est une bonne illustration des limites qui lui sont assignées. Au fait, comment en est-on arrivé là ? D'où nous vient ce principe au contenu a priori énigmatique ? Certainement pas d'ex nihilo! C'est ce questionnement qui a inspiré la rédaction de la présente note dont le souci premier est de rendre compte des débats houleux et enrichissants auxquels se sont livrés d'illustres juristes alors que commençait à fleurir le droit international privé.
