Abstract
Utilisant la métaphore de l’écosystème, l’auteure suggère que la philosophie néolibérale a déstabilisé le système normatif de la fonction publique. La « gouvernance à distance » et les délégations vers le marché et la société civile que préconise la philosophie néolibérale ont ébranlé l’équilibre qui pouvait exister entre les règles juridiques et les valeurs organisationnelles au sein de la fonction publique canadienne. L’auteur oppose les règles et les valeurs de la fonction publique « classique » à celles des secteurs privé et communautaire pour suggérer que des tensions existent et qu’il est approprié de proposer de nouvelles avenues de recherche en droit public et de développer davantage le droit du secteur à but non lucratif.
