Abstract
Ce texte donne une vue générale de l'évolution de la législation chinoise relevant du droit administratif depuis 1979. Cette évolution a été jalonnée par la mise en place d'une procédure réglementaire et d'une planification de la production législative, par la création d'une juridiction administrative sous la forme d'instances spécialisées pour traiter certains contentieux et d'une procédure générale de révision administrative, par l'adoption en 1989 d'une Loi sur le contentieux administratif uniformisant le contrôle juridictionnel de la légalité de certaines décisions administratives, complétée en 1994 par une Loi sur l'indemnisation par l'État, et enfin par l'introduction d'un régime de la fonction publique. L'évolution législative semble maintenant devoir se poursuivre en priorité sur le terrain de la procédure administrative non contentieuse.
