Abstract
Dans le présent texte, l'auteure analyse 161 jugements portant sur la prestation compensatoire de 1983 à 1991, appliquant l'article 559 du Code civil du Québec. La période de transition entre l'appropriation exclusive et le partage du patrimoine conjugal est analysée à partir des discours narratifs des parties et des juges. L'auteure fait un exposé de la demande des requérants, met en relief les silences et approximations judiciaires et présente une analyse critique de la réponse des juges et de ses fondements juridiques, le contrat et le droit civil, le tout dans une perspective féministe. Elle en arrive ainsi à illustrer la résistance judiciaire à modifier la règle de l'échange conjugal, à penser autrement les rapports conjugaux.
