Abstract
Il était traditionnellement admis que l'organisation de la famille, telle qu'elle avait été édictée par le législateur, était d'ordre public et que toute convention dérogeant aux règles gouvernant cette organisation constituait une atteinte à l'ordre public classique de direction. En revanche, la liberté était de principe dans les rapports patrimoniaux, telle la liberté dans le choix d'un régime matrimonial. Qu'en est-il aujourd'hui ? On constate que l'ordre public classique de direction, s'il se maintient dans les pays relevant d'un droit religieux, marque un recul certain dans les pays soumis à un droit laïque ; il ne disparaît certes pas, mais il cède le pas à un nouvel ordre juridique familial, le plus souvent de protection, mais à contenu variable : protection de la personne, des époux, de l'intérêt de l'enfant, des consentements, ou encore égalité, collégialité, solidarité, partage. On relève donc l'existence d'une multiplicité d'ordres qui, parfois, se recoupent, mais qui, parfois aussi, entrent en conflit et peuvent donner l'impression d'un certain... désordre !
