Abstract
Le présent commentaire critique l’opinion des juges de la majorité dans l’arrêt rendu par la Cour d’appel du Québec à propos de l’affaire Rochon c. La Reine. Contrairement à l’approche de la Cour d’appel, l’auteur de ce commentaire soutient que malgré l’absence d’une obligation légale, l’omission de faire quelque chose peut être une source de responsabilité criminelle à titre de complice. L’essentiel est que le complice s’abstienne d’agir en vue d’influencer le cours de l’infraction. De même, contrairement au jugement concordant du juge Kasirer, l’auteur du présent commentaire est d’avis que le complice n’a pas besoin de chercher ou désirer les conséquences de l’infraction principale pour être criminellement responsable de l’infraction. Il suffit qu’il sache que l’auteur principal est en train de commettre l’infraction ou est sur le point de la commettre, et qu’il lui apporte son soutien matériel ou moral en connaissance de cause.
