Abstract
La responsabilité de la justice et des juges a longtemps été considérée comme impensable à l’image de celle du souverain. Elle est aujourd’hui très discutée. En tant que service public, l’institution judiciaire semble pouvoir être appelée à répondre de ses dysfonctionnements comme d’autres administrations. Mais si cette idée fait son chemin elle ne peut conduire à traiter le juge comme un agent public ordinaire dont la responsabilité personnelle pourrait être engagée sans tenir compte de la spécificité de la fonction juridictionnelle.
