Abstract
La Cour d'appel du Québec doit trancher depuis plusieurs années un nombre d'affaires toujours grandissant. Au-delà de la lenteur du processus d'appel — premier effet de cette situation — se dessine un problème de fond : le justiciable ne peut qu'observer un état d'incertitude se dégager des délibérations d'une Cour qui ne peut plus remplir efficacement son rôle ultime, soit l'édification de la règle juridique dans une société distincte de par la langue et la tradition juridique. Dans un tel contexte, la solution consisterait peut-être en l'implantation, comme chez nos voisins américains, d'une cour suprême du Québec représentant le palier supérieur d'une cour d'appel intermédiaire.
