Le domaine des relations du travail est régi en partie par des lois d'une portée individuelle. Dans le but d'assurer la protection des salariés et le respect de ces lois, le législateur a instauré divers recours. Il peut s'agir de recours visant la récupération monétaire ou pour obtenir la réintégration et la compensation financière des salariés victimes d'une pratique illégale commise par l'employeur. La mise en application de ces régimes de protection permet de voir que plusieurs intérêts sont en cause : l'intérêt individuel du salarié, l'intérêt collectif des salariés réunis en association et l'intérêt de la société. Or, malgré la présence de différents intérêts qui souvent se juxtaposent, le législateur n'a pas accordé à chaque détenteur de ces types d'intérêts, la qualité pour exercer le droit à réclamer la sanction de la loi, que ce soit devant les tribunaux de droit commun ou les tribunaux spécialisés du travail. Fréquemment, bien que les protagonistes aient un intérêt factuel à défendre, le législateur aura préalablement déterminé ceux qui seront aptes à faire reconnaître la violation de la loi et, ainsi, à défendre leur intérêt. C'est ce que l'on observe dans l'exercice d'un recours à portée individuelle touchant le salarié. Dans la présente analyse, l'auteur déterminera les différents types d'intérêt factuellement visés dans un litige découlant d'une réclamation individuelle et mettra en évidence les motifs justifiant le législateur de favoriser un intérêt plutôt qu'un autre.
