Dans le contexte de l’application de la méthode pragmatique et fonctionnelle, l’interrogation fondamentale qui doit guider une cour de justice, lorsqu’elle examine la décision rendue par un décideur administratif, est celle de savoir si le législateur a voulu que l’examen d’une question donnée ou la solution à y apporter relève de la compétence conférée au tribunal. En théorie, le problème est résolu puisque le tribunal supérieur doit appliquer la méthode pragmatique et fonctionnelle qui comporte quatre facteurs à examiner. Une difficulté se pose toutefois. En effet, la notion d’expertise qui, selon la Cour suprême du Canada, constitue le facteur le plus important qu’une cour doit examiner pour arrêter la norme de contrôle applicable, n’a pour l’instant fait l’objet d’aucun examen exhaustif. À ce jour, la Cour suprême n’a proposé aucune grille d’analyse qui permettrait de déterminer de façon systématique et cohérente le degré d’expertise du décideur administratif. Toutefois, ce facteur est d’une importance capitale lorsqu’un tribunal supérieur doit se demander si un décideur administratif mérite que l’on fasse preuve de retenue au moment de l’examen de la légalité d’une décision qu’il a rendue. Selon la Cour suprême, l’expertise constitue la justification fondamentale de la déférence judiciaire.
