Abstract
Résumé Pendant une relation contractuelle et au terme de celle-ci, le salarié doit demeurer loyal à son employeur et ne pas lui nuire ou le tromper. Or, si l’employeur entretient des soupçons quant à l’exécution véritable et diligente de la prestation de travail ou s’il craint que son salarié le trompe, de quels droits jouit-il et jusqu’où peut-il exercer ces droits? L’employeur peut-il, par tous les moyens et au moindre doute, soumettre ses salariés à une surveillance soutenue? S’il congédie son salarié en ayant fait usage de moyens de surveillance à son insu à l’intérieur ou à l’extérieur de l’entreprise, peut-il faire admettre cette preuve devant un tribunal? Après avoir rappelé les droits et les obligations de chaque partie, cet article examine comment les tribunaux québécois balisent les modes de surveillance des salariés pendant les heures du travail et en dehors de celles-ci. En outre, il faut retenir que la surveillance par caméra vidéo doit être justifiée par des motifs rationnels et exercée par des moyens raisonnables.
