Abstract
La dernière récession économique a suscité l'apparition d'une nouvelle forme de convention collective : la convention collective à « double échelle ». Son existence pose cependant de nombreux problèmes juridiques, notamment en ce qui a trait à l'obligation de représentation juste et égale du syndicat accrédité. L'auteur s'interroge sur la validité juridique des différentes formes de convention collective à double échelle, eu égard à cette obligation. On doit distinguer les conventions à double échelle temporaire, des conventions qui instaurent de tel système sur une base permanente. Alors que les premières sont plus facilement justifiables, les secondes apparaissent bien aller à l'encontre de l'obligation légale. Dans un tel cas de contravention à la loi, on peut également s'interroger sur les divers recours qui s'offrent au salarié victime d'une telle discrimination systématique.
