Une importante réforme de la procédure civile fut entreprise en 2002 dans le sillage du rapport Ferland. Ce rapport s’inspirait du rapport Woolf en Angleterre. L’idée de proportionnalité y tient une place centrale mais elle a été codifiée dans les Civil Procedure Rules d’une manière beaucoup plus énergique qu’au Québec, en tenant compte des coûts de mise en oeuvre de la justice civile. En outre, les études d’impact entreprises ici sont moins probantes que celles réalisées en Angleterre. Les bilans de part et d’autre présentent cependant plusieurs points de ressemblance et devraient convaincre le législateur québécois de pousser plus loin la réforme par une mise à distance plus marquée de la culture adversariale, laquelle nécessite un contrôle plus étroit sur le cheminement de l’instance, un meilleur encadrement des interrogatoires préalables et le recours aussi souvent que possible à des experts uniques désignés par les parties ou par le tribunal. Vue sous cet angle, la réforme de 2002 au Québec accuse un retard appréciable sur la réforme amorcée par le rapport Woolf.
