On a pu craindre durant quelques années que la mondialisation allait ébranler l’édifice normatif québécois, en particulier les institutions de son système professionnel chargées de la protection du public. Cependant, l’adoption en 2002 du projet de loi 90, qui prévoit des actes réservés à certaines professions, pour des activités préjudiciables à la santé physique, et le débat actuel sur le projet de loi 50, qui propose une semblable réserve dans le domaine de la santé mentale et des relations humaines, montrent que, loin de s’affaiblir, le souci de protéger le public, de maintenir les institutions chargées de la discipline en matière de déontologie, de former les professionnels, de traiter et de prévenir les plaintes, s’est au contraire renforcé. Dans un contexte marqué par de nombreux cas de scandales financiers ou de malgouvernance, on aura sans doute compris, chez les élus et dans le public, que la confiance ne peut être maintenue hors d’un cadre garantissant une saine articulation des ordres sociaux. Cette analyse se veut une contribution au développement de la conscience collective à cet égard. On constatera que le législateur a commencé à resserrer les balises de gouvernance de l’État-employeur, en clarifiant les nomenclatures d’emploi, et en supprimant des zones de confusion affectant l’encadrement des salariés professionnels du secteur public.
