Abstract
Le droit civil québécois a, assez tôt, reconnu qu’en entravant le fonctionnement normal de la règle de l’accession, il était possible de provoquer la dissociation juridique d’un immeuble. Si l’appellation de « droit de superficie » a rapidement fait l’unanimité, la nature de ce droit a longtemps divisé la communauté juridique. Alors que certains y ont vu un droit de propriété, d’autres ont préféré y reconnaître un simple démembrement. La présence d’un droit de propriété et d’un droit accessoire explique qu’il ait aussi été présenté comme un droit mixte. À la faveur de la récente recodification du droit civil, le législateur a retenu, après quelques tergiversations, l’appellation de « propriété superficiaire » et rattaché la nouvelle institution à la notion de modalité de la propriété (art. 1009 C.c.Q.). La solution retenue, qui s’inscrit dans un objectif de modernisation du droit des biens, soulève tout de même des interrogations. Loin d’être un simple changement de terminologie, le choix du législateur pourrait avoir pour conséquence de bouleverser certains fondements du droit des biens.
