Le droit de la création et le droit du patrimoine se distinguent non seulement dans leur relation au droit des biens, mais aussi dans le déploiement de critères propres. Pour autant les deux univers ne sont pas étrangers l’un à l’autre. Si tout bien culturel n’est pas nécessairement oeuvre ou, symétriquement, si toute oeuvre n’est pas appelée à devenir bien culturel, il y a d’évidence un point d’intersection, un patrimoine commun. La dimension personnelle tient une place centrale dans la qualification de l’oeuvre de l’esprit, là où le droit du patrimoine prend pour pivot la valeur culturelle construite principalement autour de l’intérêt historique du bien, dans une approche plus objective consolidée par le temps. On peut voir une sorte de continuum entre l’oeuvre perçue d’abord comme création de l’esprit, puis admise dans le cercle des biens culturels. Pourtant, le droit du patrimoine protège de plus en plus tôt et simultanément, le droit de la création étend son emprise sur une durée plus longue. Servant des intérêts distincts — celui de l’auteur pour l’un, celui de la collectivité pour l’autre — ces modes de protection pourtant poursuivent des finalités communes, tous deux en quête de l’intégrité des œuvres, d’une certaine façon de leur intangibilité. Ils ont donc une proximité fonctionnelle consolidée par l’évolution de leur rapport au temps. Les critères d’élection, quoique distincts, tendent aujourd’hui à se rapprocher. Le présent article se propose d’identifier les points de contact et d’explorer l’influence réciproque du droit d’auteur et du droit du patrimoine.
