L’interprétation des droits socioéconomiques en Inde et en Afrique du Sud : par-delà le texte, la volonté judiciaire

Abstract
Dans ce texte, l’auteur cherche à démontrer qu’au-delà du texte, l’interprétation des droits économiques et sociaux relève souvent du choix exercé par le juge et de sa volonté à participer au changement socioéconomique. Pour faire cette démonstration, l’auteur mobilisera d’abord la jurisprudence de la Cour suprême indienne, puis dans une seconde partie, celle de la Cour constitutionnelle sud-africaine. Il en ressortira qu’une constitution qui limite les droits socioéconomiques au rang de principes d’interprétation non justiciables ne constitue pas nécessairement un obstacle à la reconnaissance judiciaire de véritables droits économiques et sociaux constitutionnels. Inversement, une constitution qui consacre le même statut normatif à tous les droits et libertés, n’est pas gage d’une jurisprudence si progressiste. Tout dépend, en effet, de l’interprétation que choisissent d’en faire les juges, et de l’interprétation qu’ils font du contexte.
