La légitimité du droit est souvent présentée comme le produit d'un processus homogène qui toucherait sans distinction l'ensemble des justiciables d'un ordre juridique donné. Ainsi, dans le monde occidental, le principe d'égalité devant la loi, la prééminence de l’ordre juridique sur les autres sources de normativité et la compétence juridique supposée des citoyens (car nul n'est censé ignorer la loi) fondent le caractère nécessaire et désirable du système juridique et expliqueraient la « force du droit » contemporain. Une étude du type sociologique, dont nous présentons ici les résultats, révèle cependant la fragilité de ces postulats essentiels. Prenant appui sur une enquête quantitative réalisée au Québec auprès de 1 009 répondants, l'auteur démontre, entre autres choses, que la socialisation des justiciables — et plus particulièrement leur niveau de scolarité — joue un rôle déterminant dans leur perception du phénomène juridique et explique, au sein d'une même population, la coexistence de perceptions souvent opposées qui s'éloignent des modèles trop simples sur lesquels on fonde souvent la légitimité supposée du droit.
