Abstract
La Convention européenne des droits de l'homme tient son efficacité du contrôle juridictionnel international qu'elle organise et des effets directs qui lui sont souvent reconnus par les droits internes. Les articles 8 et 12 aménagent particulièrement la protection de la vie familiale, dont la spécificité n'est apparue que récemment au regard de l'histoire des libertés fondamentales. La Commission et la Cour européennes des droits de l'homme sont plus enclines à protéger les liens familiaux qu'à permettre leur dissolution. Elles vont ainsi à contre-courant des tendances de plusieurs États membres du Conseil de l'Europe. Les familles de ressortissants étrangers semblent moins protégées que les ressortissants des États membres. La théorie des « prestations positives » est cependant extrêmement féconde pour la protection de la vie familiale, spécialement pour les familles moins favorisées socialement.
