Abstract
Ce texte présente les nouvelles législations canadienne et québécoise en matière de mariage civil et de filiation. Elle s'attache surtout à la loi québécoise qui a instauré un nouveau système de filiation : la bi-maternité d'origine. Mais non la bi-paternité d'origine puisqu'elle interdit "toute convention par laquelle une femme s'engage à procréer ou à porter un enfant pour le compte d'autrui". Elle crée donc une inégalité entre homosexuels de l'un et l'autre sexe. En instaurant de nouvelles règles de filiation, la loi québécoise s'est abstenue d'aborder la question de la pluriparentalité qui s'impose dans 9 familles homoparentales sur 10 et dans des familles hétéroparentales de plus en plus nombreuses. Une révision fondamentale du droit de la famille dans une perspective universelle reste donc à entamer. »
