Abstract
L’Assemblée nationale du Québec a adopté en décembre 2010 deux projets de loi en matière d’éthique et de déontologie : le premier s’adresse aux membres de l’Assemblée nationale, le second s’adresse aux membres des conseils municipaux et a également des incidences sur les employés municipaux. Dans son texte, l’auteur met en question la façon dont ces initiatives législatives distinguent et actualisent l’éthique et la déontologie. Après avoir souligné les insuffisances de ces lois en ce qui concerne leur volet éthique, l’auteur suggère de repenser l’équilibre entre « éthique » et « déontologie » en accordant une prépondérance aux dispositifs relevant de l’éthique.
