Abstract
La réflexion sur le formalisme, lorsqu'elle est limitée à son opposition au consensualisme, ne révèle qu'une partie du rôle qu'il joue en droit actuel. Pour dévoiler l'importance du formalisme, il faut aller au-delà de l'analyse des règles relatives à la formation du contrat. L'affirmation selon laquelle un simple échange de consentements suffit à faire naître le contrat ne rend compte, en effet, que d'une partie du droit positif. Malgré l'affirmation du principe du consensualisme, le formalisme joue un rôle important en droit actuel. Loin d'être en opposition avec le consensualisme, le formalisme est plutôt son complément essentiel.
