Abstract
Cet article analyse l’élaboration du discours autour de la puissance paternelle dans le système judiciaire québécois entre 1866 et 1928 à travers les décisions prises dans les cas de garde d’enfants. La magistrature défendait le modèle de la famille traditionnelle et hiérarchique quand elle accordait la garde au parent biologique plutôt qu’à un foyer nourricier. À partir des années 1890 cependant, les perceptions nouvelles des besoins des enfants remettent en question l’apport de chaque parent. Les pères se voient écartés de la possibilité de recevoir la garde parce que les exigences reliées à leur emploi les empêcheraient de bien veiller sur leurs enfants.
