Abstract
Le droit des minorités est tributaire de la notion d’État-nation. Cependant, la notion d’État multinational, où coexistent des nations distinctes dans une structure fédérale, commence à être défendue. Le présent texte explore comment le droit constitutionnel, les lois linguistiques et la jurisprudence récente en droits linguistiques au Canada reconnaissent ou non plusieurs nations ou en tirent des conséquences juridiques. Or le paradigme principal de ce droit s’inscrit plutôt dans l’idée qu’il y a une nation canadienne et que les communautés qui la composent sont traitées comme des minorités nationales qui reçoivent soit des droits, soit des protections spéciales dans la structure constitutionnelle.
