L’utilisation des organismes génétiquement modifiés (OGM) dans l’agriculture et l’alimentation pose des enjeux sociaux importants malgré le potentiel économique de la biotechnologie. Les applications du génie génétique en agriculture semblent conduire à l’uniformisation de la diversité biologique et menacer les débouchés économiques des pays en développement. Le génie génétique semble remettre en cause l’indépendance du monde paysan. Il est perçu comme transgresseur des précautions individuelles de la protection de la santé et des principes moraux ou religieux. Cet article adopte une optique d’utilisation durable des OGM. Il traite des perspectives de l’encadrement du droit et de l’éthique. L’étiquetage, la traçabilité et la séparation des filières commerciales entre produits agricoles ordinaires et produits agricoles à base d’OGM, sont présentés comme les premiers balbutiements d’un droit naissant. À l’international, l’adoption du principe de précaution dans le Protocole de Carthagène sur la prévention des risques biotechnologiques ouvre les portes à un étiquetage clair des OGM. Mais il faudra attendre la fin des travaux de la COP des Parties à la CBD pour voir la véritable portée du principe de précaution sur cette question et ce, pas plus tard que deux ans après l’entrée en vigueur du Protocole.
