Abstract
Les pathologies mentales en milieu de travail recouvrent non seulement les troubles mentaux d’origine non professionnelle, mais également les nombreux cas de souffrances du fait du travail (dus à l’organisation et aux relations du travail). Concernant les souffrances dues au travail, le système juridique français a une double action. En amont, il impose à l’employeur d’améliorer dans un processus continu les conditions de travail de chacun des travailleurs pour prévenir une altération ou une détérioration de l’état de santé du salarié. En aval de la survenue d’une altération de la santé mentale des salariés, il existe, dans le droit français de l’(in)aptitude, des outils incitatifs, voire coercitifs, pour imposer à l’employeur l’adaptation du poste de travail d’un salarié en difficulté et son reclassement en cas d’inaptitude au poste antérieur ou de handicap avérés. Cependant, ce droit de l’(in)aptitude qui concerne chaque salarié recèle des limites inhérentes à la question même de la santé mentale au travail.
