Abstract
La critique de la légitimité du contrôle judiciaire en matière de droits et libertés s'appuie souvent sur l'impossibilité pour les juges défaire preuve de neutralité, leurs opinions morales personnelles venant invariablement infléchir le droit. Dans une visée de légitimation d'un tel contrôle judiciaire, l'auteur soutient que, tout en reconnaissant que les juges procèdent à une lecture morale des droits, on peut néanmoins raisonnablement attendre de ceux-ci qu'ils respectent une exigence faible de neutralité, c'est-à-dire une exigence d'impartialité. Inscrivant cette thèse dans la foulée des travaux de R. Dworkin, l'auteur expose d'abord ce que Dworkin entend par lecture morale des droits ainsi que les contraintes affectant la décision judiciaire lors d'une lecture morale bien comprise. Les insuffisances de ces contraintes dworkiniennes en regard de l'exigence d'impartialité sont ensuite mises en évidence. L'auteur esquisse finalement des contraintes structurelles, complémentaires des contraintes dworkiniennes, qui s'avèrent susceptibles d'assurer le respect de l'exigence d'impartialité.
