Abstract
L'indemnisation du dommage corporel résultant des accidents de la route gagne de son autonomie au regard du droit de la responsabilité civile. Le droit français laisse pourtant subsister des hypothèses de prise en compte de la faute, et notamment de celle du conducteur. L'exemple du régime québécois, l'un des plus aboutis des régimes sans égard à la faute, offre l'avantage de distinguer la sanction de la faute de la réparation des préjudices. La Société d'assurance automobile, créée en 1979, s'est vue confier le monopole de l'indemnisation du dommage corporel des victimes, ainsi que le soin de participer à leur réinsertion sociale et la prévention des accidents de la route. Parfois critiqué pour l'indemnisation des victimes ayant commis les infractions les plus graves, le système est tout de même largement accepté et permet une maîtrise des coûts par la rationalisation de la gestion et la quasi disparition du contentieux.
