Abstract
L’homme d’affaires et homme politique britannique Edward Ellice (1783-1863) est l’un des rares seigneurs à s’être prévalu du droit de rétrocéder sa seigneurie à la Couronne pour se la faire redonner en franc et commun soccage. Il a ainsi pu vendre les terres non concédées de sa seigneurie de Beauharnois – 40 000 hectares –, ce que les règles du régime seigneurial lui interdisaient de faire. Comment cela a-t-il pu se produire ? C’est ce que l’auteur cherche ici à comprendre, en se penchant sur les aspects politiques de la commutation de tenure, les idées et les calculs d’Ellice et ses démarches pour obtenir la commutation. Il examine ensuite les conséquences de la commutation, s’interroge sur l’effet d’entraînement du geste fait par Ellice et situe finalement Beauharnois dans le contexte des politiques foncières au Bas-Canada.
