Abstract
Cet article tend à montrer la signification idéologique, les limites et les dangers des modes alternatifs de résolutions des conflits dans le droit positif actuel. Ces « justices alternatives », très en vogue à l’heure actuelle et ce depuis au moins une trentaine d’années, usent d’un vocabulaire de pacification, de paix et de modernité. Mais c’est parfois simplement pour éloigner le justiciable de son juge. Cet éloignement peut être contesté, notamment au nom du droit fondamental à un procès équitable. La mode de ces justices alternatives peut en outre provoquer des effets délétères, notamment pour les victimes sommées de se concilier avec celui-là même qui les a harcelés. Les exemples de la médiation en matière de harcèlement, de la procédure de conciliation (d’alerte) en cas de danger grave et imminent sont des exemples parlant à cet égard. L’objectif de résolution des conflits est, enfin, parfois discutable. Le conflit est parfois protégé, soutenu par le droit, comme en matière de droit de la concurrence ou de droit de grève. Et sa « résolution » rime bien souvent avec la « soumission » du plus faible.
