Abstract
La capacité de l'État d'élaborer des règles, des politiques, des modes de régulation de l'activité sociétale — capacité désignée dans la présente étude sous le vocable de potentialité étatique — s'impose comme un des attributs fondamentaux de la souveraineté. L'auteur défend la thèse que l'ALENA influe sur la potentialité étatique du Canada. Il illustre son propos par une analyse de l'incidence de l'ALENA sur l'activité étatique dans quatre secteurs : l'investissement, la culture, l'énergie et l'agriculture. Cela l'amène à évaluer la proposition selon laquelle certaines limites posées par l’ALENA à la potentialité étatique possèdent la texture d'un ordre quasi constitutionnel.
