Abstract
Le consommateur qui réalise un achat sur Internet désire s’assurer que sa transaction est protégée, sécurisée et fiable. Le potentiel du commerce à distance est aujourd’hui immense; avec l’avènement d’Internet, le consommateur peut avoir accès plus rapidement à une multitude de produits, en comparer les prix, et même conclure et exécuter l’ensemble de la transaction sans quitter le confort de son salon. Cependant, les nombreux problèmes de paiement et de livraison nuisent à l’essor du cybercommerce de consommation, La réglementation actuelle peut-elle favoriser le développement de cette nouvelle forme de commerce tout en protégeant les consommateurs contre les abus de la technique ? Pour répondre à cette question, les auteurs s’interrogent sur l’adéquation de l’encadrement juridique existant appliqué aux modalités de formation et d’exécution du contrat en ligne et, constat en main, se penchent sur la nécessité de remodeler le droit de la consommation en fonction de cette nouvelle réalité.
