Abstract
Alors que la réforme du Code de procédure civile a permis à l’intervenant d’intérêt public de faire son entrée « officielle » dans les prétoires québécois, l’article qui suit a pour objet d’illustrer les divers mécanismes permettant à des tiers dépourvus d’intérêt au sens juridique du terme de s’immiscer dans le processus juridictionnel. L’auteure propose de dépasser la signification restreinte de l’expression amicus curiae afin de savoir si le procureur général, l’expert et l’intervenant d’intérêt public peuvent être, eux aussi, qualifiés d’« amis de la cour ». Tous ont vocation à éclairer le juge, l’amicus curiae par définition, le procureur général par fonction, l’expert par mission et l’intervenant d’intérêt public par conviction. Cependant, tous ne correspondent pas à un mécanisme amical d’intervention. C’est notamment le cas de l’expert. En revanche, l’intervenant d’intérêt public est un véritable intervenant amical dont le rôle ne demande qu’à être davantage utilisé devant les tribunaux québécois.
