Abstract
Lorsque la loi marie des normes juridiques et des normes éthiques, ou l’éthique se dilue, absorbée par la déontologie, ou son sens est éludé par les règles d’interprétation. Or, l’intégration de normes éthiques dans les lois pourrait générer une transformation du droit du seul fait de l’instrumentalisation de la norme juridique à des fins éthiques. Cet article explore cette piste d’une transformation du droit et, conséquemment, d’une rupture dans sa vision traditionnelle, corrélative de la transformation de son usage, incarnée notamment par l’intégration de normes éthiques. En arrière-plan, cet article interroge les défis que pose la diversification des usages du droit dans une perspective de gouvernance.
