Abstract
Dans le texte qui suit, l’auteure examine certains fondements généraux du droit privé québécois et vérifie si ces fondements s’opposent au choix effectué par le législateur québécois lorsqu’il a rejeté le concept de lésion contractuelle, alors même que la disproportion entre les prestations des parties résulterait de l’exploitation d’un cocontractant en situation de vulnérabilité. À la suite de son étude, l’auteure conclut que ce choix législatif est incohérent au regard des préceptes généraux inscrits dans le Code civil du Québec et propose une solution fondée, notamment, sur le principe de la bonne foi.
