Abstract
La compréhension du cycle hydrologique devrait induire un intérêt global dans le maintien de ce cycle. Les gouttes de pluie, aussi microscopiques et localisées soient-elles, charrient la pollution partout sur la planète. Le droit international n’a pourtant considéré, à ce jour, l’eau douce qu’en tant que ressource localisée, soit-elle transfrontalière. Or, pour s’appliquer utilement à l’eau douce, un statut et un régime universel doivent permettre de résoudre la tension inhérente à l’objet, local et territorialisé dans ses usages et global dans son fonctionnement systémique. Il s’agit à la fois de créer les conditions nécessaires à la préservation du cycle hydrologique global et d’assurer l’application de règles d’intérêt public à des ressources territoriales, ce qui exige d’envisager le sens de la subsidiarité en l’espèce, pour prendre dûment en considération l’aspiration à l’autonomie et à l’émancipation des communautés humaines.
