Abstract
Depuis les arrêts Guérin et Sparrow, la Cour suprême a reconnu que la Couronne a une obligation de fiduciaire de protéger les intérêts des peuples autochtones lorsqu'elle transige avec eux. S'il ne fait aucun doute que cette obligation incombe à la Couronne fédérale, il en va tout autrement quant à son application aux couronnes provinciales. Le présent article tente de délimiter les paramètres de l’application de l'obligation de fiduciaire de la Couronne. L'auteur s'appuie sur une analyse historique, législative et jurisprudentielle pour démontrer que l'obligation de fiduciaire ne peut être que de la responsabilité de la Couronne fédérale.
